(1) If the employer obtains a labor permit or labor permit in accordance with rule 8 or rule 9 and wishes to extend the period of the labor permit or labor permit of foreign workers employed in his establishment, he shall submit an application to the department along with the following detailed documents thirty days before the end of such period:-
(a) Work performance level of foreign workers,
(b) If work consent of the Government of Nepal, Ministry of Home Affairs is required, a copy of such work consent letter,
(c) Progress details of the plan submitted to make Nepali citizens skilled by gradually replacing foreign workers,
(d) Receipt or receipt of submission of duty as per sub-rule (1) of rule 10,
(e) Other document details deemed necessary by the department.
(2) In the course of examining the application received as per sub-rule (1), if it is found to be inappropriate, the department may, subject to sub-rule (3) of rule 11, extend the period of such foreign worker's labor permit or work permit.
